1. Generel

1.1.
All sales are exclusively subject to the general terms and conditions (GTC) of Thomas Reischauer (hereinafter referred to as TR), in the form valid at the time of the order.

2. Offer/conclusion of contract

2.1.
The conditions for our goods are subject to change and non-binding. Our presentation of works of art on the Internet does not represent an offer, but a non-binding invitation to the customer to place an order. The colors, formats or surface quality of the works shown may deviate from the original due to the specifics of the electronic medium. All information on products, product properties and prices are subject to errors and typographical errors. TR endeavors to present the works as closely as possible to the original in order to enable an optimal presentation of the work of art, but cannot assume any guarantee in this regard.

2.2.
An order can be placed by the customer by filling out an order form provided by TR. The order represents a binding offer to the artist to conclude a purchase contract. All information (name, address, etc.) must be true and complete, otherwise the customer is obliged to compensate for any damage that may result.

2.3.
After completing and submitting the form, the customer will receive a confirmation of the order by email, which confirms receipt of the order. This confirmation does not constitute an acceptance, TR first checks, among other things, whether the desired work of art is still available. The customer is obliged to notify us of any discrepancies between this confirmation.

2.4.
The contract of sale between the customer and the artist is only concluded if the customer receives an express declaration of acceptance in writing or by e-mail from TR within the following 14 days with an attached invoice.

2.5.
The work of art will only be sent after receipt of the purchase price on the account specified by TR.

2.6.
If the customer orders the goods electronically, the text of the contract and these General Terms and Conditions will be saved in a reproducible form and sent by email.

3. Prices, shipping costs

3.1.
All prices are gross prices including statutory VAT plus shipping and insurance costs. Delivery is by carrier or post. Any applicable taxes, customs duties and storage costs are borne by the customer.

3.2.
The amount of the shipping costs depends on the shipping method and location, this is communicated to the customer in the declaration of acceptance.

4. Maturity and terms of payment

4.1.
Unless otherwise offered, prepayment (in the form of transfer to an account specified by TR) is the payment method for all deliveries.

4.2.
If you are in default of payment, we are entitled to demand interest on arrears at a rate of 3% above the general bank interest rate, as well as reminder fees.

5. Refund policy

5.1.
The customer has the right to return or send back the work of art to the address provided by TR within 14 days of receipt of the work of art without giving any reason. Prerequisite is a written notification by letter or email to TR, timely return in the original packaging and a perfect, completely undamaged condition of the work.

5.2.
The purchase price will be refunded immediately after the artwork has arrived at TR and has been checked. The customer bears the transport and insurance costs for the return.

5.3.
In the event of an effective revocation, the services received by both parties are to be returned and any benefits (e.g. interest) surrendered.

5.4.
In case of deterioration of the goods, compensation can be demanded. This does not apply if the deterioration of the item is exclusively due to its inspection - as it would have been possible for the customer to do in a shop. In addition, the customer can avoid the obligation to pay compensation by not using the item like an owner and refraining from anything that could impair its value.

5.5.
The right of return does not apply if the works of art are made to customer specifications or are clearly tailored to personal needs or are not suitable for return due to their nature.

6. Delivery, defects

6.1.
The work of art is delivered to the delivery address given when ordering, the information about the delivery period is non-binding.

6.2.
When the shipment arrives at the customer, the latter is obliged to check the delivery in the presence of the deliverer for any externally visible transport damage and, if necessary, to have such a certificate certified.

6.3.
Obvious defects must be reported to TR in writing by letter or e-mail as soon as they become known, at the latest within two weeks after handover (date of receipt by TR). Otherwise the customer loses his warranty claims in this regard.

6.4.
The works of art are sensitive to environmental influences (such as moisture, UV radiation, etc.). Some of them, especially photographs, can change their color as a result. This can also be the result of insufficient or incorrect care or storage. The artist cannot assume any liability for these defects.

7. Liability

7.1.
TR is not responsible for any damage before, during and after delivery. TR endeavors to carry out the purchase contract to the full satisfaction of the contractual partners.

7.2.
Despite careful examination, TR cannot guarantee the correctness of the information contained on this website. TR expressly assumes no liability for any content of any other linked/connected websites.

8. Retention of title

8.1.
The delivered works of art remain the property of the artist until full payment has been made.

9. Privacy

9.1.
TR is committed to protecting the privacy of anyone using this service and to keeping personal information confidential. TR stores customer data and only uses it for internal purposes. The personal data will not be passed on to third parties, unless they are partners responsible for processing the order (artists, transport companies).

9.2.
By ordering or registering for the newsletter, the customer agrees that his data will be collected, processed and used for the purposes stated in 9.1.

9.3.
The above consent can be revoked at any time with effect for the future.

9.4.
Cookies are used in this shop to make it easier for users to operate the shop. A cookie is a small text file that is stored in the browser's memory. No personal data is stored in this text file, only a sequence of numbers assigned to the respective user is stored. You can manage and, if necessary, block the acceptance of cookies from this website in your browser program. Once you have registered, you will be recognized on subsequent visits to the TR website. The data stored in the cookie makes it unnecessary for you to fill out the forms again.

10. Copyright

10.1.
All works shown are protected by copyright. In particular, it is not permitted to copy, edit, print out or publish these images. Any kind of use of the illustrations requires the written approval of TR. Violators will be prosecuted under criminal and civil law.

11. Final Provisions

11.1.
Individual agreements must be in writing to be effective. Should one of the clauses of these General Terms and Conditions be ineffective, the effectiveness of the remaining clauses will not be affected.

11.2.
Place of jurisdiction is Schärding, Austrian law applies.
